Wetlands Protection Policy – PCC Policy 22-1
§ 196-8. Notice of intent; public hearing; action by Commission – Rendering a Determination of Nonsignificance

The Plymouth Conservation Commission (Commission) adopts the following policy with respect to Rendering a Determination of Nonsignificance:
The Commission may make a determination as to whether or not the Plymouth Wetlands Protection By-Law and Rules and Regulations apply to a specific project or activity, before the filing of a Notice of Intent or a Request for Determination of Applicability.
The request shall consist of the following:
1. A letter addressed to the Commission and/or Staff describing the proposed project or activity; and
2. A plan (prepared by the Applicant or their Representative e.g., Engineer or Surveyor) that shows the project/activity location and how close it is to the Wetland/Resource Area; and
3. Photographs of the area.
Within 30 days of the receipt of a request, from any residential property owner, sent to the Conservation Office by certified mail or hand delivery, the Commission shall place the request on its agenda for consideration under the Action Items Heading at the next available meeting.
After reading the letter, analyzing the plan and viewing the photographs the Commission may decide (by motion and vote) to Issue a Determination of Non-Significance (no further permitting under the Plymouth Wetlands Protection By-Law / Rules and Regulations is required) or require the filing of a permit application for either a Request for Determination of Applicability or a Notice of Intent.
If the Commission fails to act on the request within 30 days of receipt the request shall be deemed as a Non-Significant Determination and no further permitting, under the Plymouth Wetlands Protection By-Law / Rules and Regulations is required.

The Commission shall be authorized to make a determination as to whether or not this chapter applies to a specific situation, prior to the filing of a written notice of intent under the provisions hereof, within 30 days of the receipt of a written request from any person desiring such determination sent by certified mail or hand delivered. Failure to act within 30 days of the request for determination shall be deemed as a nonsignificant determination.
